SERVICES fOR INDEPENDENT CONTRACTORS

  • Reviewing contracts to see if they are genuine or sham.  There has been an increased number of employees whose status is changed to contractors. Though most changes are to benefit both employers and employees, such changes may not be allowed by law.
  • Assisting contractors in negotiating favorable contractual terms and conditions.
  • Identifying breach of contract and/or unfair contract, and advising of appropriate actions.
  • Advising independent contractors in relation to adverse action taken against them by their principals. The adverse action provisions under the Fair Work Act apply not only to workplace rights of employees but also to that of independent contractors. 
  • Advising and representing independent contractors in relation to discrimination claims.

Adverse action claims need to be made within 21 days of the date of the alleged adverse action.
